Summary: These terms govern your use of Berkly’s Jira apps. Purchase, billing and installation run through the Atlassian Marketplace under Atlassian’s terms; the apps are provided as-is; and you can stop using them at any time by uninstalling.

There is no parent company. These Terms are not published by Berkly B.V., Berkly N.V., or any Dutch company.
These Terms of Service (the “Terms”) govern your access to and use of Berkly’s apps (each, the “App”), which are Atlassian Forge Cloud apps distributed through the Atlassian Marketplace. By installing or using an App, you agree to these Terms on behalf of your organization.
Installation, purchase, billing, evaluation, and refunds for the App are handled by Atlassian and governed by the Atlassian Marketplace Terms of Use and your agreement with Atlassian. Where those terms conflict with these Terms on matters of purchase or billing, the Atlassian terms control.
Subject to these Terms and your valid Marketplace license, I grant you a limited, non-exclusive, non-transferable, revocable right to use the App within your Atlassian Cloud site for your internal business purposes. You must not resell, sublicense, reverse-engineer, or attempt to extract the source of the App except to the extent this restriction is prohibited by law.
Any fees for the App are set on its Marketplace listing and are charged and collected by Atlassian. Refunds and cancellations follow Atlassian’s Marketplace policies. I do not process your payment details.
The App operates within your Atlassian environment. Handling of data is described in the Berkly Privacy Policy, which is incorporated into these Terms by reference.
Support is provided on a best-effort basis at info@berkly.nl. I aim to keep the App working with current Atlassian platform versions but do not guarantee uninterrupted or error-free operation.
The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of the App. Total aggregate liability for any claim relating to the App will not exceed the fees you paid for the App through the Marketplace in the 12 months preceding the claim.
I may update, change, or discontinue the App, and I may revise these Terms; material changes are reflected by a new effective date above. Continued use of the App after an update constitutes acceptance of the revised Terms.
You may stop using the App at any time by uninstalling it, which removes its Forge app storage. These Terms remain in effect for as long as you use the App; provisions that by their nature should survive (including sections 7 and 8) survive termination.
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules.
